terms & conditions

before moving forward, please read and be ready to accept my rules and terms of service.


commission rules

  1. you must be able to pay via invoice. i use invoicing in order to preserve legal rights and protect against scams and fraud. unfortunately it is the only way to receive trustworthy payment through online measures at this time.

  2. custom pieces must be paid in full upfront before work is started. once the form is filled out and submitted, i will respond to your request via email with a price estimate (shipping included). once the price is accepted and confirmed, i will send an invoice which must be paid in full upfront before you are added to the commission list and i have your commission started. note: once work has started, custom pieces are non-refundable.

  3. form submission does not guarantee commission. if a request is offensive, nsfw, etc, or the client is impolite in any way, i reserve the right to refuse a commission request. i will try my best to accommodate within my boundaries.


how commissions will work:

  1. you fill out the correct form with your request.
  2. i will respond to your request via email with a price estimate. once you confirm price, i will send you an invoice, which you must pay in full upfront. (payment options include paypal, stripe, venmo, or zelle. payment link will also be sent in that email!)
  3. once payment is received, i will start on your request.
  4. once your piece is finished i will send a final update via email and confirm your shipping address before sending it to you.
  5. you receive your piece in the mail. yay!

DISCLAIMER
By purchasing my services (artwork), you (the client) automatically agree to the following conditions as well as my rules which are public and will be reminded as necessary.

Please read the following carefully in its entirety. Your commission request will be rejected if you do not agree to these terms. If you are not comfortable with my Terms of Service and/or are not willing to agree to the conditions, please do not request a commission.

Clients are not permitted under any circumstances to use any part of a commissioned work from edlynbot (edlyn capulong) such as images, goods, and copies of goods in any block-chain related technology including non-fungible tokens (NFT), cryptocurrency, or future inventions in the space. Using any commissioned work is also strictly prohibited from use in any advertising or profits associated with block-chain related technology including non-fungible tokens (NFT), cryptocurrency, or future inventions in the space.

Any aspect of any work by edlynbot (edlyn capulong) may not be used to train, validate, or test any neural network or artificial intelligence or facilities using such technologies. Doing so is in violation of terms against alteration and external non-private use of assets created for patrons.


USER AGREEMENT
By commissioning me, you agree that you have read and accept all the terms described herein, and agree to the policy of using the art for personal, non-profit purposes unless otherwise stated, and provide all image credits to me.
Violators will be added to a blacklist indefinitely and without warning with any additional appropriate actions taken.

CLIENT
You agree to read and accept my Terms of Service.
You may display my work on external sites as long as it is visibly credited and linked back to me.
You may not upload or host my work in any gallery that is intended to display your own work only.
You may not claim my work as your own.
You may use the commissioned artwork for personal use including but not limited to: avatars, phone or computer wallpapers, and personal website/profile displays.
You reserve the right to print or create an otherwise physical reproduction of the commissioned artwork as long as it is for your personal use only (ie; not for sale).
You may not use the commissioned artwork for redistribution or external projects, commercial or non-commercial (ie; clothing, mugs, public flyers, etc.) unless otherwise discussed.
You are not authorized to change, modify, edit or use my works without my permission.
You are not authorized to trace over my artwork in any way, including the use of the artwork as a ‘base’.
Any harassment in an attempt to bargain for a commission (or commission slot) is not tolerated. This includes inappropriately worded comments on any of my social platforms, as well as private messages. I reserve the right to place anyone on a blacklist over harassment.
Clients who have commissioned and/or received work before my Terms of Service had gone into effect are still bound to its contents.
By placing an order, you agree to these terms and conditions. Please read these terms carefully.

ARTIST
By commissioning me, you are purchasing my service as an artist only.
I reserve the right to post images of your finished artwork in my gallery for any reason unless discussed and agreed otherwise beforehand.
I reserve the right to decline any project or client for any reason.
I reserve the right to refund you the full amount paid if I no longer wish to work on your project for any reason.
I will not create work containing anything considered offensive or bigoted (ie; racism, homophobia, transphobia, incest, pedophilia, etc.), or NSFW content.

COMMERCIAL USAGE
If you, the client, wish to order a commission for commercial use, the total price of the commission, as well as any other royalties, will be agreed upon upfront.
The minimum price increase is 100% of the original price, meaning double the end sum. However, I reserve the right to charge more if I deem fit.
The following cases are considered commercial use: reproducing and selling the artwork, publicly or privately, cases where you receive profit from a medium/platform where you have posted my artwork, (ie; Patreon, YouTube, Twitch, a personal site, business cards, etc).

COPYRIGHT
I reserve the right to sign my own work.
I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the image as a sample for sales or self-promotion unless otherwise agreed upon. In the case of a Public Commission, I may do whatever I wish with images of the art (ie; post it to other sites such as Instagram) but will give proper credit to you for ownership of any of your original design input.
In the case of a commission, I claim the rights to the design unless 50% or more of the design input was given by the client and image reference displaying said design was received. In these cases, I will not reuse/resell the artwork for personal or commercial projects unless agreed upon.

PRIVACY REQUEST
If you wish for your request to be private, it must be stated during the ordering process.
The privacy request entails that I am not allowed to share any work-in-progress on social media, nor am I allowed to stream the process of the commission anywhere.
However, this also means that the client must refrain from sharing any such details themselves.

ORDERING
You are expected to have read and understood my rules and discussed with me to confirm your request has been accepted. Your commission slot is only confirmed once you receive a reply from me discussing the details as needed, and payment is received in full.
I reserve the right to make changes to your request as I see fit unless otherwise discussed. To guarantee the total accuracy of your commission request, please make note of the required details and elements in the commission form.
If your commission is highly detailed in any aspect, I have the right to charge a fee to include these details. This fee will be stated before the transaction, and you hold the right to make changes to your commission request (ie; change a character, agree to simplified design changes) before the transaction is complete.
Please make your request concisely worded with minimal abbreviations, so as to make the note clear to read.
Any emails, private messages, and comments that you send must be delivered in English. Miscommunication due to mistranslation is at fault of the client.
Before taking part in any transaction, you are required to wait for a reply so that we can discuss the details.
After details are confirmed and accepted by both parties, I will send you an invoice. You must confirm the payment with me before I start your order.

PAYMENT
All goods are priced in USD ($).
Payments are processed securely through Paypal, Stripe, Venmo, or Zelle.
Payment will be taken in full before commission is accepted and put on my commission list.
I will initiate the transaction to avoid any payment errors. Do not send payment of any kind until I have confirmed your request and have sent an invoice. Failure to comply will result in a refund and potential cancellation of your commission.
If payment is not made within 48 hours after invoice is sent, commission will be cancelled. Please contact me if there are any delays or issues preventing payment.
After full payment is sent, I will start on your commission. Timing will be confirmed before starting and updates will be sent as the piece goes from greenware (raw clay), to bisque (fired without glaze), to glaze, and then final shipping.
I am not responsible for any errors made on the client’s part over the course of the transaction.

SCHEDULING & DEADLINES
I may take from 2 to 5 business days to respond to your initial order inquiry.
You reserve the right to set a deadline for your commission. This deadline must be disclosed prior to payment.
I have the right to decline a project if there is too short of a time allowance. I reserve the right to take between 4 to 8 weeks to work on a request as needed.
If due dates are discussed, it is also the client’s responsibility to ensure prompt communication. I will not be held responsible for late delivery.
No harassment over my work speed will be tolerated, regardless of the time that has passed.
I will start work on commissions chronologically as received. However, due to variation of difficulty and time necessary for different requests, slots may not be completed in chronological order.
You reserve the right to be notified of any delays.

RUSH ORDERS
Rush fees are at least an additional +25% of the commission price. Fees might vary depending on the project and the timeframe provided.
Estimated project start dates can be given upon request but cannot be fully guaranteed. However, in some cases, I am able to accept a rush commission that would bring your request to the front of the queue.
Dates provided are subject to change, details are to be discussed should the client have set dates.

REVISIONS & FEEDBACK
I will send work-in-progress images via email after full payment is received. These images will come in the form of .jpg or .png files as an attachment in the email.
The responsibility is on you, the Client, to ensure your order contains the details you want included. I am not responsible for any unsatisfactory element of the finished design if no feedback was given to amend it.
Upon finishing the initial sculpt, only one major revision can be made during the ‘greenware’ (unfired, raw clay) phase of the commission. Only minor adjustments within reason can be made to the design afterwards as the ceramic process is delicate and time-sensitive.
Each commissioned piece is final and cannot be adjusted once it has gone through its final (glaze) firing. Color mockups can be requested in advanced, but due to the chaotic and unpredictable nature of the kiln, once it has gone through its final firing, nothing can be changed.
I will not re-make a completed commission unless payment is received for a second order.

FINAL PRODUCT
There will be slight differences between commission samples and the final piece you will receive.
The commissioner must respect that my artistic style cannot be altered, and that the kiln is chaotic and unpredictable and so final pieces will reflect the volatile nature of the craft.

CANCELLATIONS & ORDER ADJUSTMENT
Cancellations only accepted within 24 hours of purchase. Any cancellations requested after those 24 hours will not be accepted. If an error was made before shipping (such as an incorrect mailing address), please get in contact to correct it. Once a package has been shipped, changes cannot be granted.

DELIVERY & SHIPPING
Physical items are shipped from the United States and will be sent out via USPS Priority Mail (for Domestic Packages) or USPS First-Class International (for International Packages) within 3-5 business days.
A shipping fee estimate will be given and the buyer must agree to pay the amount before commission is accepted. Shipping fees and shipping times vary depending on destination.
Buyers are responsible for any customs and import taxes that may apply.

REFUNDS & RETURNS
Custom pieces are non-refundable once work has started.
Turnaround time for ceramic pieces can take between 4 and 8 weeks, so please take that into consideration before requesting a piece.
I will confirm timing before starting and send updates as the piece goes from greenware, to bisque, to final glaze.
